Harrisburg City Council member Gloria Martin Roberts, ex - Harrisburg School employee Eric L. Waters and a group calling itself The Harrisburg Action Committee filed suit against the Board of Control of the Harrisburg School District, it's members - Calobe Jackson, Clare Jones, Roy E. Christ, Oscar Douglas JR, Brad Furey and CEO/Superintendent of the Harrisburg School District Gerald Kohn.

The complaint petitions the Court for equitable and declaratory relief under the statutory provisions of the Pa. Sunshine Law, the committee claims that

"Not only was Kohn a prosecution witness and the person who recommended the dismissal of Waters, attention that the BOC was directed by the mayor of Harrisburg to conduct itself as per the direction of Kohn. This may have constituted an unlawful delegation of BOC's duties and in plaintiff Waters opinion constitute a clear comingling of the adjudicatory and prosecutorial functions".

The suit questions the issue of allowing Furey and Christ to participate via phone communication claiming

"there was nothing on the record as to what numbers were called; nor was there any identification of the persons on the record that informed the public that the persons on the phone were truly Brad Furey and Roy Christ".

The committee also claims that.

"Brad Furey's action may have posed a conflict of interest when he voted to dismiss because his company has done millions of dollars worth of business for the District. This business can not be conducted without BOC approval at Kohn's direction".

The suit asks to void the decisions made by the BOC and requests attorney's fees and court costs.

Harrisburg Action Committee members are named as Eric L. Waters, Gloria Martin Roberts, Ata Zandieh, Shannon Wade, Bruce G. Weber
