Ken Lee after Judge Lawrence Clark articulated a Resolution between the Controller's Office and the Mayor's Office on the issue of payroll oversight and direct deposit. In response to Harrisburg City Controller Dan Miller's Statement on Judge Clark's June 7, 2012 Order, attorney for the Office of the Mayor, Ken Lee, issued this statement:

Apparently Mr. Miller construes the Order of Judge Clark as permitting his interference with the wages of City Employees in the manner he previously did which gave rise to numerous pieces of litigation by or on behalf of City employees, unions and the Pennsylvania Labor Relations Board over his 2010 actions.

If I read Mr. Miller's comments correctly, he is sadly mistaken and is demonstrating bad-faith as to the purpose of the court Order, displaying an attitude that will probably land him back in court again should he attempt to implement the interpretation he asserts below.

Mr. Miller repeatedly admitted throughout the process that he did not know the law when he implemented his policy violating contractual obligations and improperly interfering with the wages of City employees back in 2010 by destroying the City's direct deposit program provided to City employees. There were no unbudgeted, fraudulent and incorrect payroll disbursements then or now.

His actions at that time were directed against two politically opposed employees and gave rise to the entire series of legal actions taken on behalf of employee unions PLRB and the City administration.

Judge Clark's Order clearly mandates that the paramount concern of all parties shall be the timely payment of wages to all City employees without fail through the direct deposit payroll program the City has had in place for years and which Mr. Miller illegally halted back in March of 2010 because of his personal political disagreement with two City employees.

The Court retains jurisdiction to enforce the order and we will immediately file such a motion should Mr. Miller attempt to tamper with direct deposit payroll program again.
