From Pittsburgh Post Gazette_______ By Tracie Mauriello and Dennis B. Roddy, HARRISBURG -- At the time he chaired the state House Democratic campaign committee, state Rep. Steve Stetler rejected a plan that would have shifted the job of opposition research from state employees to private firms, a onetime top campaign aide told a state grand jury. "It was more or less shot down," Dan Wiedemer, now an aide to another House member, told grand jurors in July, just days after a dozen former House members and their staff were charged with diverting tax dollars to pay for political campaign work. He said Mr. Stetler, who at that time chaired the House Democratic Campaign Committee, suggested "we have a perfectly good system in place already." The testimony regarding Mr. Stetler took place during a still-ongoing investigation by Attorney General Tom Corbett into allegations that millions of taxpayer dollars were used for bogus performance bonuses for state employees who worked on the 2006 and 2004 election campaigns of Democratic candidates for the state House. A partial transcript, obtained by the Post-Gazette, places Mr. Wiedemer's testimony on July 29 of last year -- more than two weeks after a statewide grand jury returned a presentment charging 12 current and former House members, including former Minority Whip Mike Veon, D-Beaver, with multiple counts of fraud in the scheme. Mr. Stetler, who now is the state secretary of revenue, has not been charged as a result of that investigation. However, sources close to a continuing investigation into the use of state employees for political campaigns said investigators are trying to decide whether they have enough to build a case against Mr. Stetler and were known to be discussing that question as recently as two weeks ago. Mr. Stetler, a Democrat from York, left the House after 2006, opting not to run again in the wake of voter backlash over a pay increase legislators voted themselves the preceding year. Through a spokeswoman, Mr. Stetler released a two-sentence statement: "It distresses me that selective, confidential information from the ongoing grand jury investigation is being leaked from anonymous sources. I have confidence that the legal process will eventually reveal the facts." Mr. Wiedemer told prosecutors that he was concerned that utilizing volunteers from the ranks of state employees would not produce consistent results. The research he was discussing was so-called "opposition research," the gathering of as much data as possible about opposing candidates, including debts, mortgages and any legal problems. "The way it should have been done and the way, by the time '05, '06 rolled around, we hoped it would be done is that you hire an outside firm. You pay them $2,500, maybe $5,000 a race. They send their folks out to courthouses. They pore through the records and they give you back a nice professional book describing everything about that person's background, about your own candidate's background," Mr. Wiedemer testified. Mr. Wiedemer said he took the idea to Mr. Stetler after pricing the cost per race. A prosecutor then asked him, "Were you shot down in a way that Stetler said, well, look we can't afford this and we're not going to be able to do it or in a way that it was relayed that we can't afford this and so we're going to have our folks do this; we're going to have our employees of the taxpayers do this?" Mr. Wiedemer responded "Right. It was sort of getting back to what I mentioned earlier: Why in the world would we pay somebody $5,000 per campaign when we have a perfectly good system in place already." Mr. Stetler was finance chairman of HDCC from 1999 to 2002 and operations chair from 2003 to 2006. He resigned his House seat and HDCC position to join the Economy League in 2006. He was nominated revenue secretary in November and confirmed by the Senate in March. Several legislative aides who were assigned to Mr. Stetler received large bonuses in 2005 and 2006 and were heavily involved in campaigns, according to campaign expenditure receipts reviewed by the Post-Gazette. Several of those staffers testified before a grand jury investigating the use of taxpayer funds for campaigns. Mr. Stetler also helped round up volunteers from other lawmakers' staffs. In a May 2005 memo to fellow Democratic lawmakers, he said, "I urge you to encourage your staff to volunteer their time and talents over the next 11 weeks to the House Democratic Campaign Committee. ... The HDCC will be contacting your staff regarding this matter and I ask that you allow them every chance to participate." A trail of e-mail messages shows 2005 wasn't the first time Mr. Stetler had been directing staffers' campaign efforts. In a 2004 e-mail message Paul Martz, who was being paid as a legislative aide, suggests to Mr. Wiedemer that, "Stetler maybe send the Westmoreland delegation, sans Tangretti, an e-mail telling them that I have been assigned to work with them through the election." At the time, Mr. Martz was a state employee already assigned to work for the re-election campaign of Westmoreland Democrat Thomas Tangretti. In another string of messages in 2004 Mr. Stetler and six others -- some on state payroll and others on the campaign committee staff -- discuss plans to convene a meeting during the work day to discuss research being conducted on candidates challenging Democratic incumbents. Four months later, in another message sent to state-provided e-mail accounts, Mr. Stetler thanked 14 legislative staffers for "doing opposition research" and invited them to a party at a Harrisburg bar. Chuck Ardo, a spokesman for Gov. Rendell, who appointed Mr. Stetler to the Revenue post in November, issued a statement: "Needless to say, we are concerned about all the allegations involved in this particular affair, but we intend to wait for the grand jury to finish its work before reaching any conclusions."

Mozilo, the self-made man from the Bronx who built Countrywide Financial into the nation’s largest mortgage lender before the credit squeeze hit, has been charged with securities fraud and insider trading in a civil suit brought by the Securities and Exchange Commission.Citing e-mail messages in which Mr. Mozilo referred to Countrywide loan products as “toxic” and “poison,” S.E.C. officials said that he had misled investors about growing risks in the company’s lending practices from 2005 through 2007. During this time he also generated $140 million in profits by selling stock in the company, the S.E.C. said. “This is the tale of two companies,” said Robert Khuzami, enforcement director at the S.E.C. “Countrywide portrayed itself as underwriting mainly prime-quality mortgages, using high underwriting standards. But concealed from shareholders was the true Countrywide, an increasingly reckless lender assuming greater and greater risk.” At a news conference announcing its filing of the suit, the most prominent against an executive involved in the mortgage crisis, Mr. Khuzami said the S.E.C. had made it a priority “to pursue cases at the root of the financial crisis.” As the nation’s largest mortgage lender, Countrywide helped fuel the housing boom by offering loans to high-risk borrowers. Carl W. Tobias, a law professor at University of Richmond, said he expected to see more such cases brought by the S.E.C. “The S.E.C. would like to have back the reputation that many feel it has lost as an aggressive enforcer,” Mr. Tobias said. “I wouldn’t be surprised to see other cases.” The suit also said that David E. Sambol, former president of Countrywide, and Eric P. Sieracki, its former chief financial officer, hid from investors the high-risk nature of the loans the company was making. Countrywide needed to maintain its position as the leading lender in a white-hot mortgage market, the S.E.C. said, and underwrote increasingly dangerous loans, all the while assuring investors that its loans were top quality. Lawyers for the three men said they would defend themselves vigorously against the suit. “The lawsuit filed today by the S.E.C. does not reflect a balanced or fair consideration of the facts or the law,” said David Siegel, a lawyer at Irell and Manella who represents Mr. Mozilo. “Mr. Mozilo acted properly and lawfully at all times as the C.E.O. of Countrywide.” A lawyer for Mr. Sambol said that the S.E.C.’s case was baseless and that it disregarded public statements Mr. Sambol made detailing the liberal lending practices at Countrywide. Mr. Sieracki’s lawyer also said that the regulator’s case had no merit. “Mr. Sieracki did not violate any securities laws and committed no fraud on anyone,” said Nick Morgan, a lawyer at DLA Piper in Los Angeles. He added that his client did not sell shares in Countrywide and even purchased them during the period cited by the S.E.C. Mr. Mozilo’s up-by-the-bootstraps background and entrepreneurial success earned him accolades and outsize pay during the mortgage industry’s heyday. But he became a lightning rod for criticism in 2007 when subprime loans started to go bad and foreclosures escalated. The S.E.C. brought its case against the former Countrywide officials on its own; Justice Department officials did not file criminal charges simultaneously with the commission, as is often the case. But a securities law expert said this did not guarantee that Mr. Mozilo and his former colleagues were clear of being charged by criminal authorities. “It could mean that the Justice Department does not yet have a case proving the highest standard, beyond a reasonable doubt,” said Lewis D. Lowenfels, at Tolins and Lowenfels in New York. “They may want to see what facts come out in the discovery in the S.E.C. case and there might be other people they are interested in. Moreover, the S.E.C. is under so much pressure from Congress, they may want to move quickly and not wait for anybody.” Among the e-mail messages written by Mr. Mozilo and cited by the S.E.C. was one from April 13, 2006. In it, Mr. Mozilo told Mr. Sambol and Mr. Sieracki that loans had been written by the company without regard for its processes and guidelines. He went on to describe as “poison” subprime second mortgages, a product from Countrywide that required no down payment from a borrower.

From Michael Klein Inquirer Columnist'Captain Janks' in stir Thomas Cipriano of North Wales, the Howard Stern phone prankster who goes by Captain Janks, is sitting in Montgomery County prison in lieu of $2,500 bail, accused of taking appearance fees from tavern owners and not showing up. Plymouth Township police arrested him Thursday. He'd been wanted after missing a March 13 date at Old Mansion House Bar and Grill in Conshohocken, and a Feb. 22 date at Edge Hill Tavern in Glenside, Plymouth and Cheltenham police said. Cipriano has a preliminary hearing set for Monday in Ottsville, Bucks County, before District Justice M. Kay DuBree in yet another case, in which he allegedly scammed management at the Indian Rock Inn in Upper Black Eddy. Cipriano, 43, turned himself in to police in February to face a theft charge after the owner of Landslide Restaurant and Saloon in rural Bethlehem Township, N.J., said she paid him $350 but he never showed. "Jersey Mike" Van Jura, talent buyer for Appalachian Brewing Co. in Harrisburg, says his blog, jerseymike.org, has become a clearinghouse for tavern owners' complaints about Cipriano. Van Jura says he grew suspicious after he turned down Cipriano's request for advance payment.

Most Harrisburg School District schools will have early dismissals Tuesday because of problems related to the jump from spring to summer-like temperatures. Superintendent Gerald Kohn said the following school buildings will have early dismissal Tuesday: Foose, Shimmell, Rowland, Scott, Lincoln, Hamilton, Ben Franklin, Downey, William Penn and Steele. The elementary schools will dismiss students at 12:30 p.m. Early dismissal times vary at William Penn. Kohn said these school buildings will have a full day on Tuesday: Camp Curtin, Marshall, Melrose, SciTech High and the John Harris Harrisburg High School campus. Kohn said all schools should be open as normal on Wednesday. The buildings having early dismissals tomorrow are older buildings that have a two-pipe system where the pipes either carry hot water for heating or cold water for cooling. Kohn said that in these buildings it takes 48 hours to transition from hot water being in the pipes to cold water. The district did not have enough time to switch over to a cold water system in these buildings because it has gotten so hot so fast, Kohn said. Kohn said district parents have been notified as to which buildings will have early dismissal tomorrow and which ones will not. In schools where there is early dismissal students will be fed lunch before they are sent home. Kohn said students will not have to make up the time being lost. The district already had extra hours built into the schedule, Kohn said.

Singleton was sued by the Harrisburg Board of Control for not following the superintendents (Kohn) orders, the lawsuit was heard by Judge Lawrence F.Clark who ruled against Singleton and three other members charged in the suit, Clark ordered that for the defendants to appeal his ruling they must post a 100 million dollar bond, the defendants were initially ordered to pay the districts lawsuit costs but that decision was overturned in Commonwealth court. Judge Clark won his retention election in 2005 with the endorsement of Mayor Steven R. Reed.
