The following filing has been added to the docket of Ballen V. Corbett, a lawsuit challenging Pennsylvania's Marriage Law.

The suit was initiated after Ballen obtained a marriage license from the Clerk of the Orphans' Court of Montgomery County and had a marriage ceremony performed based on the license.

Ballen alleges that the Marriage Law provisions violate Article I, Sections 1 and 28, of the Constitution of Pennsylvania, and the Equal Protection and Due Process Clauses of the Fourteenth Amendment to the US Constitution.

The petitioners are seeking a determination of the validity of the marriage licenses that were issued to them by the Clerk of the Orphans' Court of Montgomery County.

On December 13th, 2013 the plaintiffs in Ballen V. Corbett filed a joint petition with Attorney General Kathleen Kane for leave to discontinue action against the Attorney General alleging that she is an unnecessary party to the action.

Earlier today, Attorney General Kane requested Commonwealth Court stay her response deadline until 20 days after a ruling is issued on her joint petition with the plaintiffs in Ballen V. Corbett.
