Arguments to take place in Room 5001 at 9:30 AM on September 12, 2013, at the Commonwealth Court, 601 Commonwealth Ave., Harrisburg, PA.

In Dauphin County Court of Common Pleas on August 12, there was a challenge to the efficacy of Mindlin nominating petitions. The court ruled that nominating petitions were deficient due to omission of a listing of a committee that would appoint replacement to Mindlin should Mindlin be unable to finish the campaign.

We had the opportunity to speak with Nevin following his hearing on the challenges raised to his nominating petitions. Video 1 and Video 2.

Shortly thereafter Nevin Mindlin issued the following press release. "I will not go away."

The appeal to Commonwealth Court will argue fifteen points of law, some of which have constitutional basis, that will show why candidate Mindlin has the right to have a ballot listing.

“At this time during the 50th anniversary of Rev. Dr. Martin Luther King’s speech calling for equality of opportunity for all, it is unfortunate,” says Mindlin, “that my main opponent’s operatives have concocted a way to try to deny me my civil right to run for elective office.” Mindlin is confident that justice will prevail in his favor.

Arguing for the appellant will be Lawrence Otter, Esq., a specialist in election law.
